RESUMO

This study examined 1,134 cases of violence against women in intimate partner relationships with violations of protective orders in a monitoring period of up to 15 months. The dynamics of time and violence were analyzed in the cases of multiple violation versus one-time violation, with the objective of identifying and thus neutralizing the risk factors for this type of recidivism. The results showed that early violation, serious physical violence, death threats, as well as jealousy, harassment, and control are related to multiple violation. This article discusses the results in comparison with other research and proposes measures to avoid revictimizations.

The present descriptive study analyzes stalking in a sample of 278 Spanish court cases involving partner violence and contrasts the benefits of the new bill article 172ter, which criminalizes stalking, compared with the Organic Law 1/2004 on partner violence. Thirty-seven percent (37%) of the total sample included stalking behaviors, which manifested in intimidatory (60%) and controlling (45%) unwanted verbal communications (62%) and physical approaches (42%) that ended violently in a third of the cases (35%). Cases involving violent stalking, non-violent stalking, and physical violence without stalking were compared. A closer look at violent stalking cases uncovered that intimacy-seeking stalking behavior was concurrent with face-to-face aggression with a sharp object, whereas pursuit/control and invasive behavior were associated with property invasion and damage. Data not only support the contention that stalking should be criminalized regardless of the type of stalking behavior but also indicate that differences in the behavior might warrant different management interventions.

RESUMO

Se analiza la situación de la participación de los psicólogos en el Sistema de Justicia en los últimos 5 años. Se entrevistó medianteun cuestionario a una muestra de 105 psicólogos de la Comunidad Autónoma de Cataluña, tomada aleatoriamente del conjunto totalde psicólogos colegiados en la misma.En base al cuestionario confeccionado para la investigación se analizaron 169 variables, divididas en 10 bloques. Éstos abarcandesde el desempeño y experiencia profesional y ámbito de especialización hasta la influencia del informe en las sentencias judiciales,pasando por cuestiones éticas y deontológicas.Además de presentar los resultados obtenidos y contrastarlos con estudios anteriores, se ha obtenido información que puede ayudara clarificar la situación actual de la práctica psicológica ligada al Sistema Judicial, pudiendo así servir de base para la mejora de larelación entre los entornos profesionales de la Psicología y el Derecho (AU)


This article analyzes the situation of psychologist’s participation in Justice System in the last five years. It has been used a 105 psychologistssample of the Autonomous Community of Cataluña, taken by random of the whole group of collegiated psychologists inCataluña.A questionnaire has been explicitly created to the investigation, and 169 variables divided in 10 blocks have been analyzed. Theseblocks embrace from professional performance and experience and specialization area to influence of the report in judicial sentences,passing too through ethical and deontological questions.Not only obtained results are presented and contrasted/compared with previous investigations, but also important information hasbeen obtained that might help clarifying the current situation of the psychological practice in relation to the Judicial System, whichmay be useful to lay foundations of a future approach between the professionals of psychology and law (AU)

The aim of the present study is to elaborate an instrument (CSM-P), valid for victims and aggressors, to assess satisfaction of individuals participating in a penal mediation program (VOM). The instrument was administered to a sample of 213 subjects, randomly chosen from the pool of participants in a VOM program of Catalonian Justice Department. Data analysis of the questionnaire shows an internal consistency of .88 (Cronbach's alpha). The dimensionality of the questionnaire is structured in a single factor that accounts for 61.45% of the variance. The instrument has proven its utility for assessing the satisfaction of the participants in a penal mediation program. Validation of the instrument in similar populations should be performed and it should be adapted to other contexts where assessing user satisfaction in a mediation program is necessary.

El objetivo de este trabajo es la elaboración de un instrumento para valorar la satisfacción de los usuarios de un programa de mediación penal (VOM), válido para víctimas y agresores. Aplicado a una muestra de 213 sujetos, seleccionados aleatoriamente entre la población de usuarios del programa VOM del Departamento de Justicia de Cataluña. Los resultados tras el análisis de los datos muestran una consistencia interna del cuestionario de 0.88 (a de Cronbach). La dimensionalidad del cuestionario se estructura en un único factor que explica el 61,45% de la varianza encontrada. El instrumento creado (CSM-P) ha mostrado su utilidad para la valoración de la satisfacción de los usuarios de un programa de mediación penal. En posteriores trabajos se necesitará validar el instrumento en poblaciones similares y adaptarlo a otros contextos donde también fuera necesario evaluar la satisfacción de un programa de mediación

RESUMO

El presente estudio analiza la presencia del acoso en el seno de situaciones de violencia doméstica. Para ello se analizó la presencia de dicha conducta y sus características en un conjunto de 46 sujetos, 20 homicidas y 26 maltratadores no homicidas mediante la aplicación del PPAD (Perfil Psicológico del Agresor Doméstico), una entrevista semi-estructurada. Los resultados muestran la presencia del acoso como una conducta habitual en situaciones de post-agresión en violencia u homicidio doméstico caracterizada por su acción sorpresiva y la tendencia a disponer a la víctima en una posición de vulnerabilidad. Ambos grupos muestran diferencias en la motivación psicológica del agresor, el tipo de acoso, así como en la intensidad y extensión de dicha conducta sobre la víctima


This article study the presence of stalking in domestic violence. Forty six subjects were studied, 20 homicides and 26 batterers not homicides using the PPAD (Psychological Profile of Domestic Aggressor), an semi - structured interview. The results show the presence of stalking like a common post- offence behavior in domestic homicide or violence. Both groups present as finality to place the victim in a position of vulnerability using a surprising approach. In other way, both groups show differences in the criminal psychological motivation, the type of stalking used and the intensity and extension over the victim
